Abstract: Contract remedies, abuse of contractual autonomy and the role of the judge – The essay starts from an historical survey of the doctrine on contractual remedies, which began in the 1970s and continues to the present day, declining in various jurisprudential “strands” (banking and financial contracts; contracts implementing agreements in violation of art. 101 TFUE, etc.). It then examines the issue of the abuse of contractual autonomy, in its conceptual premises and its applicative implications, highlighting some aporias at a systematic level. It concludes with a reflection on the role of the judge, called to carry out his difficult mission in a context that has now abandoned the scheme of the subsumption to a specific law provision, but which continues to advance requests for predictability and certainty of judicial decisions.
