Abstract: Art. 1467 of the Italian Civil Code and the supervening impossibility of the contractual cause – Art. 1467 c.c. deals with the problem of unforeseeable circumstances, but the traditional interpretations of the rule considerably limit its scope of application. The historical context in which the provision was conceived, and the inseparable connection between the normal risk of the contract and its cause, allow a new interpretation of Art. 1467. Indeed, whenever extraordinary and unforeseeable events impact performance to such a degree that its value surpasses the threshold of normal risk, this results in a shift in the concrete cause of the contract: the legal impossibility of the performance, when transposed to the structural level of the whole contract, becomes thus ‘supervening impossibility of the cause’.
