Abstract: Comments on recent developments regarding the appointment of a liquidator and liability actions in compositions with creditors – This article deals with the regulation of liability actions against company directors in compositions with creditors (concordato preventivo) resulting from the direct and/or indirect amendments introduced by the recent Legislative Decree No. 136/2024, in relation to these restructuring proceedings. The aim is to examine whether the relevant provision—i.e. Article 115 of the Code on Business Crisis and Insolvency—has actually been modified, and if so, to what extent in particular with regard to standing to sue.
