Note sulla codificazione del diritto civile in Cina (Diego Corapi)

Abstract: Note on the codification of civil law in China – The 2021 Civil Code marks China definitive election for a regulation of private relations not on custom but on a legal system of which the Code is the fundament. This approach, based on the civil law tradition and on the romanistic doctrinal culture, leads to a prevailing presence in the Code of norms of judgment over norms of conduct and on a structure of the Code divided with a General Part (similarly to the BGB) and six books, with the remarkable innovation of a book devoted to personality rights (among which a right of privacy).
