Abstract: Partnerships and business crisis –The article addresses the issues raised by the restructuring of partnerships in crisis, identifying the specific features related to the participation of partners and the subsequent adjustments to be made to the regulations governing companies in a preventive arrangement under Articles 120-bis et seq. of the Codice della crisi. In particular, the work focuses, on the one hand, on the enhanced protection of partners’ rights with respect to amendments to the articles of association, and, on the other hand, on the unlimited liability for corporate obligations, concluding with the protection of partners with unlimited liability in the event of choosing a preventive arrangement with business continuity.
