Abstract: The ‘Enrico Gabrielli doctrine’ and Bridge of Spies: Notations on economic transaction and private autonomy – The paper reconstructs Enrico Gabrielli’s ideas with reference to the concept of «economic transaction», attempting to identify its ascendants, including cultural ones, and questioning the legal value of this notion. The Author of the paper argues that this notion constitutes not only an essential hermeneutical category, necessary to identify the discipline applicable to transactions with a complex structure – and usable even where are lacking the prerequisites for the identification of a contractual link in the technical sense between the different acts into which the bargain is divided – but also a necessary parameter for the concretization of the ‘good faith clause’ in a possible judgment of integration of the content of the regulation, as fixed by the parties.
