Abstract: Credit purchase and regulation of financial activites – The essay focuses on regulatory issues concerning the activity of credit purchase. At present, no common UE regulation standards are set: credit purchasers are not regulated at all in some cases, while in others, like in Italy, they are required to obtain an authorisation as a financial institution, ruled by the consolidated banking law (as credit purchase is regarded as being a financial operation, even if the operators are buying credits at their own risk). The uneven framework will not be made up of the directive 2021/2167 on credit servicers and credit purchasers, as it concerns only credit purchase of NPL, originally issued by a credit institution, leaving regulatory differences between member states and determining competition asymmetries between operators.
