Abstract: The substitute powers of the bankruptcy administrator pursuant to art. 264 of the Crisis and Insolvency Code – The essay examines the powers that art. 264 of the Crisis and Insolvency code attributes to the official receiver. After analyzing the meaning that the new provision assumes in the context of the “company law of the crisis”, are illustrated the faculties envisaged by art. 264, 1st paragraph, their content and scope of application. Then, we proceed to examine the powers provided for by art. 264, 2nd paragraph and, finally, the profiles relating to the impugnation of the decisions of official receiver are examined in depth.
