The uncertain boundaries of the concept of obstructing the exercise of the functions of the public supervisory authorities (Elisabetta Pietrocarlo)

Abstract: The definition of ‘obstruction’ to the functions of supervisory authorities is the main problem of the crime provided for by Article 2638, paragraph 2, of the Italian Civil Code, since its descriptive gap has allowed the Italian courts to adopt an excessively broad interpretation which contradicts the fundamental principles of criminal law. This contribution aims at analysing, also from a critical perspective, the theoretical debate and the development in case law on the matter, in order to identify an interpretation of the notion of ‘obstruction’ in compliance with the principles of ‘offensiveness’ (‘offensitività’) and ‘extrema ratio’.
