An interpretative issue posed by a contrast between the regulatory sources regarding extraordinary administration procedure: art. 38, paragraph 1-bis, d.lgs. 270/1999 and art. 4 D.M. 60/2013
Abstract: The article examines the requirements for taking up the office of commissioner of extraordinary administration procedures according to the Italian law. Namely, by dealing with an interpretative issue posed by a contrast between the regulatory sources on the subject matter, the article clarifies that an occasional professional service (i.e. una tantum), such as the drafting of an opinion on legal or accounting matters, does not preclude the taking up of the office of commissioner.
